Welcome to Lovisoft ("we," "us," or "our"). These Terms of Service ("Terms") govern your access to and use of CRM Solid (the "Service"), including our website crmsolid.com, our application at app.crmsolid.com, and related services.

By accessing or using our Service, you agree to be bound by these Terms and ourPrivacy Policy. If you disagree with any part of these terms, you may not access the Service.

2. Eligibility & Accounts

You must be at least 18 years old and have the legal capacity to enter into contracts. By creating an account, you represent and warrant that:

2. You will maintain the accuracy of such information
3. You are responsible for safeguarding your account credentials
4. You will notify us immediately of any unauthorized use of your account

3. Permitted Use

You may use our Service for legitimate business purposes, including:

1. Customer relationship management (CRM) activities
2. Authorized outreach and communication campaigns
3. Marketing automation within legal boundaries
4. Team collaboration and workflow management

You must comply with all applicable laws, regulations, and the terms and developer policies of any platform you connect — including Telegram, Meta (Instagram, Facebook, WhatsApp), X (Twitter), TikTok, LinkedIn, and Google.

4. Prohibited Activities

You agree not to engage in any of the following prohibited activities:

1. Sending spam, unsolicited messages, or harassment
2. Scraping data without proper consent or authorization
3. Distributing malware, viruses, or harmful code
4. Reverse engineering or attempting to extract source code
5. Circumventing rate limits or security measures
6. Violating any applicable laws or regulations
7. Impersonating others or providing false information

5. Messaging & Automation Rules

You are solely responsible for the content and recipients of your messages. You must:

1. Comply with anti-spam laws (CAN-SPAM, GDPR, etc.)
2. Obtain proper consent before messaging recipients
3. Provide clear opt-out mechanisms
4. Honor unsubscribe requests promptly
5. Maintain accurate recipient lists and preferences

6. AI Features Disclaimer

Our Service includes AI-powered features for content generation and automation. Please note that:

1. AI-generated content may contain errors or inaccuracies
2. You must review and approve all AI-generated content before use
3. We provide no warranties regarding AI content accuracy or suitability
4. You remain responsible for all content sent through our Service

7. Third-Party Services

Our Service integrates with third-party platforms including Telegram, Meta (Instagram, Facebook, WhatsApp), X (Twitter), TikTok, LinkedIn, Google, AI providers (Anthropic and OpenAI), and payment processors. These services are independent of us, and their availability, terms, or changes may affect our Service. We are not responsible for third-party service interruptions or modifications.

When you connect a third-party account, you authorize us to access it on your behalf through its official API solely to provide the features you enable, and you agree to comply with that platform's terms and developer policies. You may disconnect any connected account at any time, which revokes our access and deletes the stored credentials for it.

8. Billing, Subscriptions & Trials

Our Service offers subscription plans (Starter, Pro, Business, Enterprise). Key billing terms:

1. Subscriptions automatically renew unless cancelled
2. Free trials convert to paid plans unless cancelled before trial end
3. Charges are non-refundable except as specified in our refund policy
4. Price changes require 30 days advance notice
5. You are responsible for applicable taxes

9. Refunds & Chargebacks

Refunds may be available within 7 days of purchase under certain conditions. Unauthorized chargebacks may result in account suspension. Please review our Refund Policyand contact our billing team before initiating any chargeback procedures.

10. Fair Use & Rate Limits

To ensure service quality for all users, we implement fair use policies and rate limits:

1. Account limits per subscription tier
2. Daily job execution limits
3. API request rate limits
4. Data scraping quotas
5. Storage and bandwidth limitations

Excessive usage may result in service throttling or account suspension.

11. Data, Privacy & DPA

Our data handling practices are detailed in ourPrivacy Policy. For enterprise customers, aData Processing Addendumis available. Data is processed in the European Union (Frankfurt, Germany) with logs retained for 90 days.

12. Security

We implement reasonable security safeguards to protect your data, but cannot guarantee absolute security. You are responsible for maintaining the security of your account credentials, API keys, and devices.

13. Intellectual Property

The Service and its original content, features, and functionality are owned by Lovisoftand protected by intellectual property laws. Your content remains yours, but you grant us a limited license to operate the Service.

14. Feedback & Publicity

Any feedback you provide becomes our property. With your consent, we may use your company logo and name for marketing purposes. You may opt out at any time.

15. Beta / Experimental Features

Beta or experimental features are provided "AS-IS" without warranties. These features may change or be removed without notice.

16. Service Changes & Availability

We may modify, suspend, or discontinue the Service at any time. Scheduled maintenance will be announced in advance when possible. No SLA is provided unless specified in a separate Enterprise agreement.

17. Termination

Either party may terminate this agreement at any time. Upon termination, your access will cease and you have 30 days to export your data. We may terminate immediately for violations of these Terms.

18. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.

19. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS-IS" AND "AS-AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. WE DISCLAIM ALL IMPLIED WARRANTIES INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

20. Limitation of Liability

OUR LIABILITY IS LIMITED TO THE AMOUNT YOU PAID IN THE LAST 12 MONTHS. WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES TO THE EXTENT PERMITTED BY LAW.

21. Governing Law & Dispute Resolution

These Terms are governed by the laws of the Republic of Türkiye. Disputes will be resolved in the courts of Istanbul, Türkiye, or through binding arbitration as mutually agreed.

22. Export & Sanctions Compliance

You are responsible for compliance with all applicable export controls, trade sanctions, and import regulations. You may not use the Service in violation of such laws.

23. Updates to Terms

We may update these Terms from time to time. Material changes will be notified via email or service notification. Continued use after changes constitutes acceptance.
